Terms and Conditions

Malique by me, located in Hoofddorp at Jacob Obrechtlaan 60, 2132 KV

1a. These terms and conditions apply to all agreements to be entered into and entered into by Malique by me for the purchase and delivery of products via the Internet.

1b. If the customer refers to his/her or other general terms and conditions, those terms and conditions do not apply.

2. All quotations are made without obligation and while supplies last. All prices we charge are in euros and exclude VAT and shipping costs. If you are a foreign customer, you do not have to pay VAT.

3. Prices can be adjusted by Malique by me at any time.

4. All Malique by me customers must register in advance using the registration form on the website. Customers must register under the name with which they are registered with the Chamber of Commerce. Malique by me only supplies to industry-oriented customers and will therefore check your Chamber of Commerce details.

5. The agreement to purchase and deliver the goods is concluded after order confirmation of an order given for this purpose by the customer. The customer will receive the order confirmation by e-mail. Our order confirmation is deemed to correctly reflect the content of the agreement. After the customer has placed an order via the Malique by me website, the customer will receive a confirmation from us. If products are not in stock, they will be adjusted and the customer will receive the final invoice from us. Products cannot be exchanged  or exchanged for other items.

6. Payment of the amount owed to us can be made in the following ways:

• transfer in advance to the bank account: the customer transfers the amount to be paid to account number  NL 44 ABNA 0497596091 in the name of Malique by me.

Once payment has been credited to this bank account, the goods will be shipped within 2 to 3 working days. If payment is not credited to this bank account within 7 days of ordering, the order will automatically expire.

8. Specified delivery times are only target times, effective as soon as all information required for the execution of the agreement is in our possession, and are therefore not binding. If this is exceeded - for example as a result of late delivery by the manufacturer or the postal service - the customer cannot assert any rights against us. Malique by me is therefore not liable for any damage resulting from exceeding the delivery period.

9. The shipping costs for Malique by me are €8, excluding VAT within the Netherlands. For orders to the islands, an additional island surcharge of €12.50 will be charged. With the exception of the island surcharge, orders over €900 (excl. VAT) will be processed. Postage free shipping. For foreign shipments, the costs are determined based on the weight of the package and the destination. You can find the shipping costs on the invoice.

10. The risk regarding the products to be delivered is transferred to the customer as soon as they are presented at the destination. If the customer fails to accept the products, the resulting damage and costs will be at his expense. Any returns to Malique by me are at the customer's expense and must be made free of charge and with a written statement of reasons.

11. After receiving the goods delivered by Malique by me, the customer must immediately check these goods. If there is anything wrong with the delivered goods, the customer must report this to Malique by me within 2 working days. After these 2 working days, this warranty expires. It is therefore very important that the customer always checks the goods after receipt. In the event of problems, the customer must inform Malique by me in writing of the problem. It is not possible to exchange and/or return items.

12. The customer has a 6-week warranty on the goods delivered by Malique by me, this only applies if the customer has handled the product properly. If the customer wishes to make a claim under the warranty, Malique by me has the right to determine whether the product can be returned. The customer can only claim the warranty after showing the purchase invoice. Prior to a return, the customer must first contact Malique by me to inquire whether a product can be returned or not. These products that have been returned will be credited or settled with a subsequent order. No replacement product will be sent back. The customer can only return the product to the place where the customer purchased the product. If the customer still sends the product to the head office in Nijmegen without having purchased it there, or if the product falls within the warranty provision, the shipping costs are at his own expense. We do not provide a warranty on zippers.

13. The information entered by the customer is registered in accordance with the European General Data Protection Regulation (GDPR) and will only be used to provide the requested information or to deliver the ordered items to the correct destination. The data will not be provided to third parties.

14. Nothing from this website may be used for your own purposes without permission.

15. Malique by me is never obliged to pay any compensation to the customer and others, except in the event of powerlessness, intent or gross negligence on the part of Malique by me.

16. In the event of force majeure - meaning any circumstance beyond our control, of such a nature that compliance with the agreement cannot reasonably be expected of us - the customer cannot claim damages from us.

17. Our quotations and agreements are exclusively governed by Dutch law.
